Orson Welles’ Use of Long Shots

Orson Welles, Hollywood’s boy genius, brought his innovative approach which has, as Andre Bazin states in Orson Welles: A Critical View: â€Å"shaken the edifices of cinematic traditions†. One of the formal characteristics that he is most well known for is the use of long takes. Although the use of long takes was already established in film, as many of the first films had no edits, Welles incorporated long takes effectively in his films to overload scenes with activity adding more dramatic tension.The films that his formal characteristic stands out the strongest are two of his more popular films Citizen Kane and Touch of Evil. Orson Welles’ theatrical background and his love for painting are probably the greatest contributions to his long takes in which an entire scene is shot with a camera using deep focus lens to capture everything clearly within the frame. As seen in both films the long shots can be static or tracking shots. Because of the deep focus, his long shots were more effective for creating complex mise-en-scene, overflowing the frame with multiple actions.Although using long takes are effective, they require talented crewmembers and are both very expensive and time consuming. Welles even stated in an interview that he â€Å"obviously prefer to control the elements in front of the camera while it’s rolling, but that requires money and the producer’s trust†. The overall effect created each scene as its own complete unit of time and space. It also allows the viewers freedom to scan the scene and look wherever they wish, which is like how one would see real life or sitting in a theater watching a play.In the film Citizen Kane Orson Welles use of long take is seen throughout the entire film. Orson Welles’ director of photography Gregg Toland used very wide-angle lenses bringing the angle of the shot close to that of the eye’s normal vision. With such open composition at Welles’ disposal, it p rovided him with â€Å"the tools needed to inject heightened tension and dramatic intensity† that wouldn’t have as much of an impact with traditional montage editing styles.For instance, during the scene of Citizen Kane in which young Charlie Kane’s future is being laid out for him, the audience watch his mother going over financial papers with the banker and Charlie’s future guardian in the foreground, Charlie’s father complains about his lack of control in the situation in the middle ground and deep in the background Charlie is seen through the far window playing in the snow unaware of the tragic twist that will affect his life. Seeing the different story elements all in one shot adds more dramatic tension, and even dramatic irony to the story.In the film Touch of Evil, Welles returns to his use of long take and deep focus after returning to Hollywood’s machinery, crewmembers and big budget capable of supporting his innovative formal chara cteristic. Before then, Welles made movies in Europe and had to resort to using short takes due to lack of money and very few European crews being capable of performing the long takes. Welles opens the film with a 3 minute 30 second single shot that starts with a close-up of a bomb being placed in the trunk of the car before it drives off.Then the camera elevates and follows the occupants of the car, then follows the Vargas couple with the car returning to cross the US-Mexico border. Finally it ends with the Vargas couple kissing before the car explodes off screen. The use of the single long shot in this scene was effective in creating dramatic tension with the audience, showing Welles’ brilliance with timing and dramatic irony. The fact that the audience is expecting the bomb to go off at the different instances when the car stops at crossings and is near vendors, customs officials, and the Vargas couple builds anticipation for an explosion.The car later explodes off screen giving the audience dramatic relief while at the same time robbing them of a visual explosion. Orson Welles’ use of long shot allows him to pack the screen with action and give the audience the illusion of freedom to follow what they want in a scene making the audience being more invested because they believe they found out the conflict on their own. Not only that, but also from individuals who are seeking a means in which to do everything possible to ensure this matter is resolved in a timely fashion (Silagy Lancaster T, 2007). They will become more open to the idea of having new people in Congress who will advocate for them, and to make it difficult for tobacco companies to exist any longer. Anyone who is a smoker may at first become opposed; however, in the future, they will understand that it was for their own good (Prochaska, et al., 1993).Smoking cessation is not an easy topic for anyone to fix because of how long this has occurred over the years. Government may or may not do anything if someone is not there to push the matter forward by making a new bill out of it for people to learn their lesson from when selling smoking products to consumers (Jorenby, et al., 2008). All of those individuals know that they are harming people’s bodies, and making their life shorter, but it is as if they do not care about anyone except themselves (Peto, Darby, Deo, Silcocks, Whitley, Doll, 2000). Everyone does understand that it feels good to relieve stress through alcohol and drugs; however, this will not solve the problem for anyone who is continuously seeking ways of improvement with their own life. They will have to find other avenues in which to make it easier to handle the stresses of life (Prochaska, Velicer, DiClemente, Fava, 1988). For example, a person can go to the gym and exercise for many hours, instead of smoking for an hour. This will make him or her feel good. Lack of parental interaction Zafi is the eldest child and he has two younger siblings. He was an average student in primary school with no discipline problems. When he was 11 years old, his father passed away. After the death of his father, his mother holds two jobs to make ends meet. His mother relies on him to take care of his two younger siblings as she is always not at home. Currently in secondary two, his academic result is very poor. In class, he would keep to himself and would shy away from classroom activities. He would sometimes cheat in tests and exams. The reasons he gave for cheating are, not having the ability to do it and he does not want his classmates to think that he is stupid. His form teacher tried many times to meet his mother to discuss about his cheating behaviour and poor academic performance but she is always busy with her work. After school, Zafi would meet up with his neighbourhood friends. Most of them are drop outs. They constantly told him to quit school and to enjoy life just like t hem. Zafi enjoys spending time with them as he thought they understand him best. They would also smoke and drink alcohol. He would only return home very late at night or not at all. Zafis father had passed away and his mother is too busy working to support the family. There is almost no interaction between Zafi and his mother and there is no other important adult to supervise him at home. In short, the parental involvement is almost non-existent. Using Bronfenbrenner Bioecological Theory and Baumrind Parenting Style Theory, I would relate how Zafis parental interactions and parenting style affects his context of development. Bronfenbrenner Bioecological Theory According to Bronfenbrenner, the lack of parental interaction is the most destructive force to a childs development. [1] Urie Bronfenbrenner says that there are two environmental conditions that are necessary for human development. The first is that one or more adults must love the child unconditionally; the second is that the adults must encourage the child and spend time doing joint activities with the child in and out of the home environment. [2] Zafis mother loves him unconditionally but she is too busy to show it and she is also unable to spend time with any of her children. Therefore, the two important conditions are not met. Bronfenbrenner also developed a Bioecological Theory to explain how the childs environments can significantly influence his cognitive development and his growth. The theory consists of 4 systems nested around each other with the child being in the innermost. The 4 systems developed by Bronfenbrenner are: microsystem, mesosystem, exosystem, and macrosystem. [3] The microsystem is where a child has direct interactions with parents, teachers, peers and others. In Zafis case, he has very little interaction with his mother and he spends most of his time with his neighbourhood friends. Too little interactions with his mother causes a break down in his microsystem and the bad influence he is getting from his neighbourhood friends is not helping in his positive growth and development. The second level is the mesosystem. Mesosystem are linkages between microsystems such as between a childs teacher and his parents, and relationships between students and peers. His teacher tried many times to c reate a linkage with his mother but failed due to her busy work schedule. This contributes to a break down in his mesosystem. The third level is the exosystem. Exosystem are external experiences in which a child does not have an active role but still influence the childs developments. In this case, his mothers busy work schedule is the exosystem. Her two jobs require her to work long hours and irregular shifts. This resulted in her having very little face time with her children. The last level is the macrosystem. Macrosystem consists of things that influence and sometimes support the child such as cultures, norms, and laws. The break down in his microsystem will affect the other systems as it disabled him to explore other parts of his environment. Without the presence of proper supervision or love, Zafi will try looking for attention in inappropriate places. These behaviours will give rise to problems such as little self discipline and no self direction. Neglectful Parenting According to Diana Baumrind, parenting styles come in three main forms; authoritarian parenting, authoritative parenting, and indulgent parenting. [4] The degree of supervision and discipline shown by Zafis mother is minimal, and there is no consequence for unacceptable behaviour. She does not deliberately encourage Zafi to self regulate his behaviour and there is very little communication between them. These are the characteristics of neglectful parenting. Even though she fulfills her children basic needs such as food and clothing, sadly, she is detached from their life. She is also psychologically unavailable to her children. Neglectful parenting style rank lowest acro ss all life domains. Children with neglectful parents tend to lack self-control, have low self-esteem and are less competent than their peers. They often engage in high-risk behaviours and are vulnerable to substance abuse. [5] Interventions Bronfenbrenner said that to ensure healthy child development, one or more adults must love the child unconditionally and they must spend time doing joint activities with the child in and out of the home environment. However, in Zafis case, this is not possible for his mother. What she could have done to increase the level of interaction with her son is by communicating with him more through the phone. During her short breaks at work, she could have called her son to ask about his day at school, find out whether he has eaten and to also provide psychological and emotional support in case his son is upset over a school event such as a failed test. This way, the child knows his mother cares for him and he can also feel his mothers love and affection. She should also try to take at least a day off weekly to spend valuable face time with her children. If it is not possible, she should ask her parents for help in taking care of her children while she is at work. There must be at least one adult present at home so that the child would not feel neglected. As for the teacher, he needs to be flexible to adjust to the parents inflexible work schedule. If meeting with the parent in person is not possible, he should at least keep in close contact with the parent through the phone and to update her about her sons learning progress and behaviour. In doing so, he is successful in creating a linkage with the parent. Once there is a linkage, it will be much easier for both teacher and parent to work together to ensure the childs healthy development. The teacher can also educate parents about the developmental needs of children. Research indicates that family involvement in schools increases student achievement (Henderson Berla, 1994). [6] The benefits of parent and family involvement include higher test scores and grades, better attendance, more completion of homework and more positive attitudes and behavior. Next, I would relate how Zafis parental interactions and parenting style affects his self and identity development. Self-Esteem Children look to parents and other important adults for evidence that theyre smart, capable, etc. This evidence may be in the form of encouragement, praise for accomplishments, awards, etc. If the evidence is not present, low self-esteem develops. [7] This explains why neglectful parenting results in children with low self-esteem. Low self-esteem can have a big negative impact on academic performance. Once a child does poorly in school, he will start to think poorly of himself and it may cause him to underachieve or make him give up completely. Children with low self-esteem tend to be lonely in school as they find it hard to make new friends. They would shy away from classroom activities as they do not want to appear incompetent. Resisting negative pressures would also seem difficult for these children. [8] Looking at Zafis case, it is obvious that he is suffering from low self-esteem. He is doing very poorly in school and at home he never gets the encouragement he needs to make him feel better. He is also not motivated to study as no matter how well he performs, his mother is not there to praise or acknowledge his accomplishments. In class, he is afraid to get involve in classroom activities and he constantly keeps to himself. He is also not able to resist negative pressures from his neighbourhood friends. As he spends more time with them, he developed a sense of belonging towards them and this sense makes him want to be like them. Interventions It is important that teachers look out for and help students who are suffering from low self-esteem as it can affect their academic performance and also their overall well-being. Teachers should be paying more attention to students like Zafi. They tend to have low self-esteem due to the lack of attention, love and affection. Students with low self-esteem will say things like, I know that I will fail or I hate myself. They tend to avoid getting involved in new activities and would have trouble making new friends and mixing around. Stresses faced at home such as parents arguing a lot and difficult lessons can have a negative impact on a childs self esteem. Some of the things that teachers can do to improve students self-esteem are, to always accentuate the positive, avoid criticism, set realistic expectations for the students and give them the opportunity to tell the class things they like about themselves. Those with very low self-esteem will have problem with even saying two things t hey like about themselves therefore, the teacher have to provide prompts for these students. Eriksons Psychosocial Development Theory Erik Erikson highlighted the importance of relationships with others in the formation of ones own identity. He believed that personality develops through eight stages of life. He suggested that at each stage of life an individual is confronted by a crisis (Erikson, 1950). At this age, Zafi is going through stage 5 crisis of Eriksons Psychosocial Development Theory which is Identity versus Role Confusion. In this stage, adolescents struggle to resolve the question of Who am I? They move from their parents to peers as a point of references. They strive to clarify their own personalities. They are often observed to imitate the attitudes and actions of others they admire. In Zafis case, his neighbourhood friends are his only point of reference. As he respects and admires them, he chose to imitate their attitudes and actions. He would smoke and drink alcohol with them till late at night. Interventions In Identity versus Role Confusion stage, adolescents will move to peers as a point of reference. As Zafi is not close to anyone else in school, he is left with no choice but to see his neighbourhood friends as references. What can be done by the teacher is to introduce buddy system to pair up low self-esteem student such as Zafi with a higher self-esteem one. The higher self-esteem student may be able to help Zafi with his studies and thus increasing his confidence and self-esteem. Zafi may look up to his buddy as his role model and thus imitate him instead of his neighbourhood peers. The teacher should also provide plenty of opportunities for students to explore identity issues as they relate to understanding who they are as individuals. An activity such as making a collage about themselves or writing their autobiography is a good way for them to explore themselves. The teacher can also enhance students self esteem by encouraging the students to substitute negative self-statements with a positive one. Lastly, I would relate how Zafis parenting style affects his moral development. His mother neglectful parenting style resulted in him lacking self-control, having low self-esteem and feeling less competent compared to his peers. His low self-esteem caused him to have low self-confidence which led him to believe that he does not have the ability to pass his examinations. As he does not want his classmates to think that he is stupid, he decided to cheat in his tests and examinations. Kohlbergs Stages of Moral Development The reason why Zafi cheated is based on self-interests. From his reasoning, his moral development is in Level 1: Preconventional Reasoning; Stage 1: Punishment-Obedience, of Kohlbergs stages of moral development. His reasoning is characterised by a focus on the consequence experienced by him as a result of his actions. Interventions To minimize cheating, teachers should clearly spell out the consequences of cheating and to consistently follow through with these when cheating does occur. Teachers can also help students overcome the need to cheat by providing the student with extra help and reducing student anxiety. Student anxiety can be reduced by emphasizing that mistakes are okay and a part of learning.

This is because of his criticism on the governments handling of allegations of statutory rape in one of his constituents by former Chief Minister of the state of Melaka, Tan Sri Abdul Rahim Thamby Chik. Consequently, while the Attorney General decided not to press charges on Rahim Thamby Chik, Lim Guan Eng was charged under Section 4(1) (b) of the Sedition Act 1948 and also under Section 8A (1). The victim who was actually a Malay girl was initially detained by Malaysian police without parental consent for 10 days. With the verdict on the trial of Malaysian parliamentarian Lim Guan Eng due to be delivered shortly, Amnesty International reiterates its concern that Lim Guan Eng could face up to six years in jail and be disqualified from Parliament. Amnesty International considers that the charges against Lim Guan Eng were politically motivated, designed to intimidate dissenting voices and to limit debate on an issue of genuine public concern. Amnesty International believes that if convicted, he would be a prisoner of conscience imprisoned solely for the peaceful expression of his political views. Lim Guan Eng was charged in 1995 under the Sedition Act and the Printing Presses and Publications Act. His trial opened in January 1996 and concluded on 28 February 1997 at the Malacca High Court. The judge who was Datuk Mohd Noor Abdullah was expected to deliver his judgment on 28 April 1997. Due to the happening of this incident, Lim Guan Eng was barred from standing for election for a period of five years. Base on the rule, members of parliament who are jailed for a year, or who are fined more than RM2000 (approximately US$780), will automatically forfeit their parliamentary seats. In addition, Amnesty International concern that Lim Guan Eng could be imprisoned. Besides, the organization is also concerned that if he is convicted, his constituents will be denied their elected representative simply because he spoke out on their behalf. Malaysian police arrested and charged Lim Guan Eng after he had publicly criticized the governments handling of allegations of statutory rape against the former Chief Minister of Malacca, Tan Sri Abdul Rahim Tamby Chik in the year 1994. In January 1995, Lim Guan Eng also stated that double standards were being applied in the statutory rape case. Attorney General Mohtar Abdullah had decided not to prosecute Rahim Tamby Chik, while the underaged alleged victim, a fifteen-year old Muslim school girl was placed under protective custody. On 28 February 1995, Lim Guan Eng was accused under Section 4(1) (b) of the Sedition Act of prompting disaffection with the administration of justice in Malaysia. If he found guilty, he need to face up to three years in jail and a RM5000 (approximately US$1,960) fine or both. In addition, on 17 March 1995, Lim Guan Eng was charged under Section 8A (1) of the Printing Presses and Publications Act for maliciously printing a pamphlet containing allegedly false information specifically because he had used the term imprisoned victim in reference to the alleged rape victim. This charge carries a jail term of three years, a fine not exceeding RM20000 (approximately US$7,894) or both. Following the Federal Courts ruling, Judge Datuk Mohd Noor Abdullah ruled that the prosecution had in fact proved both charges against Lim Guan Eng beyond reasonable doubt and that the defense had a case to answer. Regarding Lim Guan Engs allegedly seditious verbal statements, the judge ruled that the report of a single junior police officer which was unsupported by an audio recording, constituted sufficient evidence to proceed. Besides, regarding the charges of printing false information, the judge ruled that the prosecution had proved beyond reasonable doubt evidence and suggesting that the phrase imprisoned victim was false. This was apparently ignoring assertions that the statutory rape victim had been detained by police for ten days without parental consent. Finally, after a series of appeals, Lim Guan Eng was sentenced to 18 months of imprisonment. However, he was released after 12 months on August 25 in the year of 1999. During the judicial procedure, Lim Guan Eng said that If I fail and have to go to jail, I have no regrets. I have no regrets of going down fighting for the principles of truth and justice and pursuit of human rights, especially womens rights. There can be no womens rights if women rape victims are considered equally responsible, and even detained, whilst the accused remain free.  [2]  Lim Guan Eng is such a good politician that stands on behalf of justice. Contributions of Lim Guan Eng in Penang As a politician, Lim Guan Eng does play his roles and manage to carry on all his responsibility towards the society. He had contributed so many things that are benefit to our society. In Malaysian general election at the year of 2008, the coalition of DAP-PKR-PAS later known as the Pakatan Rakyat had won 29 out of 40 state seats contested, in which DAP is the largest winning party with 19 seats, PKR 9 seats, and PAS 1. Thus, it defeated the former ruling coalition of Barisan Nasional for the authority to rule Penang for the next five years. However, Lim Guan Eng is not a resident in Penang. So, as the Secretary-General of DAP, he was nominated to be the next Chief Minister (CM) of Penang and replacing the long serving former Chief Minister Tan Sri Dr. Koh Tsu Koon. Senior DAP leaders of Penang such as Lim Hock Seng, Phee Boon Poh, and Chow Kon Yeow were bypassed and were instead appointed as excos. As the new Penang Chief Minister, Lim Guan Eng announced an amnesty on all summonses issued by the Penang Municipal Council and Seberang Perai Municipal Council which involving vendors licenses and parking offences issued before March 2008. On March 14, a rowdy group comprising mostly Umno members and supporters took to the streets illegally after Friday prayers to protest his statements on the NEP. No arrests were made but two men were taken in for questioning. Various BN-backed groups and NGOs continued to make different sorts of protest and lodge police reports as a form of continued harassment.  [3]   Besides, in year 2008 on March 19, Lim Guan Eng announced that the state exco had approved an open tender system for projects exceeding RM50,000. For projects between RM20,000 and RM50,000, a balloting system will be introduced. Furthermore, a two-week objection period would be given for both the open tender and balloting systems. This is a stark contrast to BN governments usual way of directly awarding lucrative contracts to companies without any form of open tendering, mostly to shell companies created by connected personnel or BN politicians. For example, there is a major project which is the Penang International Convention Centre (PICC) was nearly launched without open tender. As of 2010, Penang remains the only state in Malaysia that practices a blanket open tendering system.  [4]   During his tenure as Chief Minister in Penang, it has ranked top among the list of investments in Malaysia which attracting RM12.2 billion worth of total capital investments in 2010. This is also a 465% increase compared to the total investment of RM2.17 billion as of 2009. Consequently in 2011, Penang became top in manufacturing investment in Malaysia for the second consecutive year, with RM9.1 billion in total. In a new measurement indicator of total investment however, which comprises manufacturing, services and private sectors, Penang ranked second in Malaysia after Sarawak in total investments, with the total amount of RM14.038 billion, this was due to not having much primary sector investments.  [5]  Consequently, the public debt in Penang has decreased by 95% from RM630 million in 2008 to RM30 million at the end of 2011.  [6]   On April 28, 2011, Lim signed a memorandum of understanding (MOU) with China. This is witnessed by Chinese premier, Wen Jiabao and Malaysian Prime Minister, Najib Tun Razak on the proposal of the construction of three road and tunnel projects in Penang island. This had including a 6.5 km undersea tunnel, a third link between the island and Butterworth on the mainland. According to the AG report, the consolidated fund has increased by 2.7%, from RM1101.89mil in 2009 to RM1,131.17mil in 2010. Likewise, the consolidated revenue fund has surged by 6.2% from RM538.95mil in 2009 to RM572.49mil in 2010.  [10]   Other than that, there is one program in the Penang state government which is named by Cleaner, Greener Penang. This program is launched by Lim Guan Eng in the year of 2010. The purpose of this program is to transform Penang into the environmentally friendliest and most livable city in Malaysia through education, enforcement and appreciation. This is to restore the current living environment into a cleaner and more sustainable city, which in turn improving the quality of life.  [11]   There are basically four objectives of Cleaner, Greener Penang. The first objective is to improve the quality of life and create a greener public realm. This is to create a sustainable and inclusive community in order to achieve a better living environment. The second objective is to raise awareness and education. This is to encourage the spirit of volunteerism and to forge a committed leadership, strong partnership active community involvement, desire for quality and innovation. The third objective is to carry out policy mapping and institutional Improvements. Lastly, the last objective is to to get the basics right. This is to have effective policies and department process maps to tackle the cleanliness issues and to raise awareness to provide a better living environment for the communities. There are also many reasons for the program of Cleaner, Greener Penang. The first reason is to envision a better living environment. Next, this program is to reposition Penang as a sustainable city. The other reason is to revitalize the urban space and streetscape. Finally, it is an initiative that brings change to the way of Penang residents lifestyle and to be the Habitat of Choice, My Penang My Pride. Due to the program of Cleaner, Greener Penang, Lim Guan Eng enforced the ban on free plastic bags throughout the state on January 1 in the year of 2010. In order to ensure of the renewal of business licenses, retail stores, food outlets and hawker stalls state-wide are required to adhere to the rulings which is the ban of free plastic bags. The proceedings from the sale of plastic bags went to the Partners against Poverty Special Fund to assist the states hardcore poor. This initiative was the first of its kind in Malaysia.  [12]   In the other hand, on December 11 of the year 2011, Lim Guan Eng initiated the Car Free Day which would be held every Sunday at particular stretches of roads in the interior city of George Town, Penang. In June 2009, during the Penang Outlook Forum, Lim Guan Eng also launched a think tank invest in Penang. The intention of this SMART Centre is to provide market intelligence, business advisory, information and resources and training services to small and medium enterprises (SMEs) in Penang. However, those families with less than RM770 monthly income will have the difference topped up by the state government every month. In other words, a family with RM600 monthly income will receive RM170 monthly under this program.  [18]   Controversy in His Political Life On September 20, 2011, Australia Broadcasting Corporation had conducted an interview with Lim Guan Eng. However, the Malaysian news agency, Bernama reported that he had criticized over disparaging remarks about security of the state of Johor.  [19]  During his speech, he said that You dont have to worry about your safety when you come to Penang. In Johor, if you are a Singaporean, you are likely to get kidnapped. Lim Guan Eng insisted he never mentioned Johor during his interview. Wong Kim Fei, who is a press secretary of Lim Guan Eng had wrote a letter to Bernama editor-in-chief Datuk Yoo Soo Heong, saying that the article that had published was false, untrue and a pack of lies. Instead, he said Lim Guan Eng had merely discussed the Malaysia Solution deal with Australia, the governments pledge to repeal the Internal Security Act (ISA) and Penang issues. Besides, he demanded that Bernama retract their story and issue a formal apology or face a lawsuit.  [20]  He also hopes th at they will continue to uphold professional journalistic standards of integrity and truthfulness by doing so again. Opinion is free but facts are sacred. After that, Lim Guan Eng has apologized to the Sultan of Johor and his subjects over the alleged disparaging remarks he made about Johor in Singapore. It is because the recording of his remark was revealed by the government controlled television channel, TV3, showing clear evidence of his proclaiming that Singaporeans who are in Johor are likely to be kidnapped. On December 14, 2011, Lim Guan Eng has won the defamation suit against Malay daily Utusan Malaysia, which has been ordered by a High Court to pay RM200,000 in damages for publishing a defamatory article about Lim Guan Eng and a cost of RM25,000 to him. Justice Varghese George Varughese, in allowing the defamation suit by Lim Guan Eng against the Malay daily, said he had examined the seven paragraphs containing the defamatory words and found that they were malicious, had intention to mislead readers and was written in bad faith. The article is entitled Kebiadapan Guan Eng (Guan Engs Arrogance) which had defamed his political career and subsequently picturing him and Democratic Action Party (DAP) as anti-Malay and anti-Muslim. The papers publication company, Utusan Melayu (M) Bhd, in its statement of defence, stated that the article was published in response to Lim Guan Engs verbal attack against the paper during his speech at the Pakatan Rakyat convention in Kepala Batas on 19 Decembe r 2010.  [21]   On June 22, 2011, Lim Guan Eng has won the second defamation suit against Utusan Malaysia, which was ordered by the Penang High Court to pay Lim Guan Eng RM200,000 in damages and RM20,000 in costs. Lim Guan Eng had claimed a March 12, 2008 article headlined Tiada Lagi DEB (No More NEP) in the Malay-language newspaper which said he would abolish the New Economic Policy was inaccurate.  [22]   Earlier in 2012, Penang state UMNO claimed that the developer of Penang World City in Bayan Mutiara made no provision for mosques, pointing out that the plot has yet to be subdivided. According to Chief Shaik Hussein Mydin, under the Town and Country Planning Act (TCPA) 1976, all land must be sub-divided according to an approved project plan before land title can be transferred to the developer. However, he said that the Penang government had failed to observe the rule in the Bayan Mutiara land deal. Lim Guan Eng responded that the developer Ivory Properties Group Bhd (IPGB) will only do the subdivision when it submits development plans for the 41.5-ha real estate to Penang Municipal Council (MPPP). In his statement, he said that the new plans and subdivision of title has not yet even been submitted, how can Umno claim that the mosque or school land has been sold or disappeared. Umno must remember that there are standard requirements for schools and places of worship including surau or mosque that are compulsory by local government or must be included in any development project. He also stressed that the people-centric state government would hold on to its fundamental principles and not let land marked for schools and places of worship to disappear. The DAP secretary-general will take legal action against Umno and Utusan Malaysia for claiming that he had sold off the mosque land, and warned Barisan Nasional (BN) from further stoking religious tension. Lim Guan Eng was willing to retire from politics if critics of the deal could prove that the land sale was not done through an open and competitive tender.  [23]   On 6 December, 2012, Lim Guan Eng wants to prove in court that he is not corrupt and doesnt take RM 40 million donations. Penang UMNO Youth Chief Shaik Hussein Mydin and Gerakan have claimed that the Chief Minister has personally received money from Kuala Lumpur International Dental Centre (KLIDC) in respect of its proposed private hospital in Penang. His special legal officer Andrew Yong said in a statement that they have made a baseless claim against the Chief Minister. Alternatively, they should prove their case in court when Lim Guan Eng sues them for their defamatory statements, which are intended to damage his public image and political career. Shaik, UMNO Youth nor Gerakan have so far shown any proof to back their baseless allegations that KLIDC offered money to the Chief Minister to help secure the tender award for the 1.1 acre piece of land in Taman Manggis to build a private hospital. In fact, it was Health Minister Liow Tiong Lai himself who announced that KLIDC has finally obtained a license to operate the private hospital in Penang. These conditions were inspired by three major changes: the aftermath of the reformation, the need for an increased governmental financing, and the reorganizing of central governments. These three points were each resolved in a different way in both England and in France. The first major point which eventually increased political power was the aftermath of the Protestant reformation. In England, after the establishment of the separate Anglican church of England there were many protestant groups left in England still in conflict. These groups all tried to push and pull parliament in their favor -- which ultimately made it so that nothing could be done. These conflicts even came to the point of bloody civil wars and suffering on both sides of the fighting. Parliament ultimately decided to stop these wars by creating religious Act of Toleration (1689) for the non-conformist protestants. For many people, this caused more unity in England and increased power. In France, the decision was made to unify the country through the establishment of a single religious authority, the Catholic Church. The king of France became the heart of this policy, which gave him control of religion when this went into effect. The next major point was the increase in need for governmental financing. In England, taxing had become under the control of Parliament. In addition to this, the cost of running a government in general had gone up and the country needed more money. Because the king didn't have as much power to tax as he pleases, the government could make a firm and accurate taxation of the people. In France, the price of government had also gone up. Harley and his lifelong friend Arthur Davidson. They were both born and raised in Milwaukee, WI. It took them almost three years to build their first production ready motorcycle which was a single cylinder, 10 cubic inch engine. Sexuality in The Wife of Bath and the Pardoner In Geoffrey Chaucer’s The Canterbury Tales, an eclectic mix of people gathers together at Tabard Inn to begin a pilgrimage to Canterbury. In the General Prologue, the readers are introduced to each of these characters. Among the pilgrims are the provocative Wife of Bath and the meek Pardoner. These two characters both demonstrate sexuality, in very different ways. Chaucer uses the Wife and the Pardoner to examine sexuality in the medieval period. The Middle Ages were a time of expanding and experimenting sexually for the people. Religious figures who had taken vows of celibacy had children, sometimes with more than one woman. Even some popes of the time had illicit affairs. However, adultery was often condoned, especially in knights, because the Chivalry Code expected of them certain â€Å"actions†: An act of infidelity was no disgrace, always provided that one preserved the form of polite society†¦Any knight who contented himself with wedding a virgin before himself having grown practiced in adultery and carried off several trophies of the chase was unworthy of his spurs. Adultery was a social diversion for the upper classes. A knight had to have a lady whom he worshiped†¦Church and state tolerated the adulterous relationship†¦It was the thing to choose a celestial patroness†¦(1) At the same time, women were repressed in their sexual feelings and were subject to their husband’s demands. This includes public authority intervention and is based on different concerns of the principal legal systems. They go on to state that monopolies, cartels and mergers are the three principal issues of interest for most competition law systems, the major concern with cartels and mergers being that, eventually they will achieve a monopoly position, dominate the market and exploit their position. Generally, the fundamental purpose of competition law is to ensure that markets for producing and selling products are effectively contestable.Competition law therefore exists to regulate the conduct of businesses, by preventing them from entering into anticompetitive agreements and abusing a dominant position, to ensure open and fair competition for both consumers and businesses. Nations adopt competition laws for various reasons hence it is important to state expressly if possible, in the legislation the goal that it seeks to achieve for easier implementation. Various goals have been put across to justify the existence of competition law which are discussed in the ensuing discussion at length. DISCUSSION: The consumer interest and protection from anticompetitive behaviours by cartels and firms with market power, has been stressed as the primary goal of competition law. In any economy there are competing interests between industry and consumers hence the former wish to amass wealth at the expense of the latter. It is therefore necessary for competition law to protect the ignorant consumer from the gluttony competitive tendencies of firms. Under the UK Enterprise Act 2002, section 11, the importance of the consumer is seen where super complaints are made to the Office of Fair Trading (OFT) by designated consumer bodies. Also, the OFT fined Manchester United, and other football clubs for their role in harming the consumer by resale price maintenance, of replica football strips. Another goal is to ensure preservation of liberty and prevention of the concentration of economic power. R. Whishcharacterized this as â€Å"the promotion of economic equity rather than economic efficiency†. It is a political ideal that relates to the pure competition objective, that economic power should be fairly distributed and is based on the idea that economic corporations should not become more influential than elected democratic governments.Jones and Suffrin therefore argue that competition law may serve the purpose of upholding the foundation of liberal democracy, by precluding the creation of excessive private power and that it decentralizes and disperses private power and protects individual freedoms, in a competitive market structure, where individual sellers and buyers are insignificant in relation to the si ze of the market. Competition law also aims at protecting competitors and ensuring fair competition. The argument behind this goal is based on the premise that, competition law should be applied to foster the ability of smaller companies to compete more directly with established larger companies. R.Whish argues that the competiton authorities should, ‘hold the ring and ensure that the â€Å"small guy† is given a fair chance to succeed’. That competition law should be concerned with both competitors and the process of competition. This is also known as the â€Å"populist goal† and has been heavily criticized by the Chicago school of antitrust analysis, who argue that antitrust intervention to protect competitors from their more efficient rivals is harmful to consumer welfare, since small inefficient firms may take wealth from consumers. I subscribe to the view that where a smaller firm is equally or more efficient than a rival but because of its financial resources it cannot survive a price war, competition law should protect it. Creation of unified markets and prevention of artificial barriers to trade is another goal of competition law. This is also called market integration, which led to the birth of the European Union (EU). Its overall aim was to integrate the member states, to create more united Europe, with a common; market, economic and monetary union, to achieve sustainable economic growth and economic development, to compete favourably in the world market. Indeed this resulted into the eventual birth of the Treaty on the Functioning of the European Union which regulates a total of 27 European country markets and protects the regional economy of the EU. Competition law may also service social, economical or industrial, environmental and regional goals. For instance, before approval of a merger competition au thorities may look at other issues outside competition like job creation or job losses. Such goals should however be accommodated in other governmental arrangements to allow for meaningful competition. On analyzing the above goals, it can be concluded that there is need for competition law in a poor country like Kenya or Tanzania, to attain economic development. G.R Bhatiai stresses that the absence of fair competition eludes stakeholders the benefits of competition, persuading countries to either enact competition law or to modernize their existing legislation and to revamp Competition Authorities. In Tanzania the Tanzania Electric Supply Company (TANESCO), monopolises distribution of electricity and takes advantage of this to charge high prices. It is argued that such monopolies discourage innovation, but through the promulgation and enforcement of a well-designed competition law, attainment of equality is possible since provisions to curb abuses by dominant firms will have a positive impact on the proper functioning of markets and equitable distribution of wealth. For instance, Section 59 (2) of the The Botswana Competition Act, 2009 permits the Competition Authority to assess whether a proposed merger may interalia, enhance competitiveness of a citizen owned small and medium size enterprise, to encourage fair competition in the market. Competition law however, serves as a tool in the alleviation of poverty, through the regulation of firms by ensuring that they do not charge high prices, which directly affects the consumer. It has been stated that due to Cartel conduct, countries such as Tanzania, Chile and Malawi have suffered a rise in food prices hence more than 100 million people have been pushed to deeper poverty. However in South Africa, two pharmaceutical giants accused of engaging in excessive pricing of branded antiretroviral had to engage in a settlement agreement hence medication fell between 58% and 88% in South Africa. It has been argued however that due to interalia lack of resources, skill and capacity to implement competition law, other concerns like poverty, illiteracy, and health should be attended to. The severe shortage of trained professionals to assess the complex competition law concepts also questions the need for competition law in poor country like Tanzania.Also competition law perse cannot achieve the goals stated above for it to be beneficial to Tanzania. Furthermore, the Fair Competition Act needs to be amended, to deal with the challenges discussed above to instill confidence in investors in the market and to protect consumers. CONCLUSION: Though arguments for and against the need for competition law have been advanced, it remains relevant to a greater extent and it must go hand in hand with the goals it aims to achieve.
